However, that is not how the Obama administration originally sold itMaybe I missed something, but I thought a court, any court, could only work with the facts given to them. So ... since it was passed (by the court) as a tax but claiming it as a tax did not come up in court, did the court make an error?

I agree with you, Max. However, I think this might actually turn out well because it 1) paints the President as a liar, and B) gives Republicans and libertarians the opportunity to make "TAX INCREASE FOR THE MIDDLE CLASS" their talking point from now to November.
Now what remains is to answer the question, "What do you replace it with?" with NOTHING because it is not a constitutionally granted role of the federal government to require or define health care coverage for anyone.
